SynapseChat Terms of Service

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

1. Acceptance of Terms

1.1. Binding Agreement: By inviting, installing, accessing, or using the SynapseChat Discord bot ("Service," "Bot," "SynapseChat"), you ("User," "You") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service and remove the Bot from any servers you control.

1.2. Authority: If you are using the Service on behalf of a Discord server, organization, or entity, you represent and warrant that you have the authority to bind that entity to these Terms.

1.3. Age Restriction: You represent that you are at least 13 years of age (or the minimum age of digital consent in your country). If you are under 18, you represent that you have obtained verifiable parental or guardian consent to use the Service. We reserve the right to request proof of age or consent at any time and to block users who fail to provide it.

2. Service Usage & License

2.1. Limited License: Subject to your strict compliance with these Terms, SynapseChat grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for non-commercial purposes within the Discord platform.

2.2. Global Relay Functionality: You acknowledge that SynapseChat is a Global Relay System. Messages sent in a designated SynapseChat channel are instantly broadcast to third-party servers not under your control. You understand that:

Your username, avatar, and message content will be visible to thousands of strangers.
We cannot control how third-party users react to your content.

2.3. Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service (including specific commands or connectivity) at any time, with or without notice.

2.4. Commercial Features & Subscriptions: SynapseChat offers paid optional features ("Subscriptions") to support the maintenance of the network.

A. Server VIP Subscription:
- Ad Immunity: Servers with an active Server VIP subscription are exempt from network-wide advertisements. The Bot will automatically filter out Sponsored Messages for these communities.
- Visual Perks: May include features such as the display of the Server's Icon in the global chat embed.
B. User VIP Subscription:
- Visual Perks: Includes cosmetic enhancements such as a "Custom User Tag" displayed next to your name in the global chat.
- NO Ad Immunity: User VIP status applies only to the individual account's cosmetics. It does NOT prevent the user from seeing network-wide advertisements. Advertisements are broadcast to the server channel; therefore, unless the Server itself holds a Server VIP Subscription, all users (including User VIPs) will see the advertisements.
C. The Advertising System:
- The "SynapseChat Official Ad System" is a restricted feature. Access to purchase advertising slots is not guaranteed and is subject to network milestones (40+ Active Servers).
- Monopoly: SynapseChat retains the exclusive right to monetize traffic on the network. Third-party advertising is strictly prohibited (see Section 3.2).
D. Payments & Refunds:
- All subscriptions and advertising purchases are final and non-refundable, except where required by law.
- We reserve the right to change the price or features of any subscription tier at any time.

2.5. Message Mechanism & Permanence (The "Relay & Replace" Protocol): You acknowledge and agree to the specific technical operation of the relay system:

Automatic Deletion: Upon sending a message in a connected channel, the Bot will automatically and immediately delete your original user message.
Embed Re-Broadcast: The Service then re-transmits your content as a "Bot-Authored Embed" to all connected servers.
Irreversibility (No Edits/Deletes): Because your original message is deleted and replaced by a Bot message, you technically cannot edit or delete your message once sent. The broadcasted Embed belongs to SynapseChat.
Staff Authority: Only authorized SynapseChat Staff possess the administrative capability to force-delete or retract messages from the Global Network.

3. User Conduct & Zero Tolerance Policy

Using SynapseChat is a privilege, not a right. We enforce a Zero Tolerance Policy regarding the following prohibited activities. Engaging in any of these will result in an immediate, permanent, and non-appealable ban from the entire network.

3.1. Prohibited Content: You explicitly agree NOT to transmit, distribute, or link to any content that:

Violates Discord TOS: Breaches Discord’s Terms of Service or Community Guidelines.
Hate Speech: Promotes violence, incites hatred, or perpetuates discrimination against individuals or groups based on race, ethnicity, religion, gender, age, disability, or sexual orientation.
Illegal Content: Depicts or promotes illegal acts, including but not limited to doxing, swatting, hacking, fraud, or the distribution of child sexual abuse material (CSAM). All CSAM violations will be immediately reported to the NCMEC and law enforcement.
Personal Information (Doxing): Reveals private information about another individual without their explicit consent.
Malicious Files: Contains viruses, malware, grabbers, or any code designed to disrupt, damage, or limit the functionality of any software or hardware.
NSFW/Explicit Material: Contains pornography, nudity, or sexually suggestive content in non-NSFW designated channels.

3.2. Advertising & Solicitation (The "Monopoly" Clause): To maintain the quality of the network, ALL forms of unauthorized advertising are prohibited.

Unauthorized Advertising: You may NOT post Discord Server Invites, URL links, social media handles, or promotional material of any kind in the public chat. The only authorized method of advertising on the SynapseChat network is through the official SynapseChat Ad System.
Circumvention of Restrictions: SynapseChat employs automated filters to block unauthorized links. Any attempt to bypass, trick, or evade these filters to promote content is a severe violation. This includes, but is not limited to:
- Breaking up links (e.g., "discord dot gg").
- Using QR codes or images containing links.
- Encouraging users to check your profile, status, or bio for links.
- Soliciting Direct Messages (DMs) for the purpose of advertising.
- Intent: If our system misses it, but our Staff determines your intent was to advertise, you will be permanently banned.

3.3. Server Owner Responsibility: If you are the owner or administrator of a Discord server using SynapseChat:

You are strictly liable for the conduct of your members within SynapseChat channels.
If your server is deemed a "raid haven" or fails to moderate its own members effectively, your entire server will be blacklisted from the network.

3.4. Language: To ensure effective global moderation, all communication in public relay channels must be conducted in English.

4. Moderation, Logging, and Enforcement

4.1. Absolute Discretion: SynapseChat Staff retain full, absolute, and sole discretion to moderate content. We are not required to provide warnings, explanations, or evidence for any moderation action taken.

4.2. Discretionary Enforcement: SynapseChat Staff retain full authority to exercise judgment and discretion when enforcing these policies. We reserve the right to evaluate the context and intent behind any specific action.

Context Matters: Sharing a helpful resource may be permitted at staff discretion, while sharing a promotional link will be penalized.
Final Decision: The decision of a Staff member regarding whether a specific message constitutes "Advertising" or "Prohibited Content" is final. Attempting to argue, debate, or "rules lawyer" a Staff member's judgment is prohibited.

4.3. Monitoring & Recording: You expressly consent to the monitoring, recording, and storage of your interactions with the Service. We log User IDs, Message IDs, and Content for security and moderation purposes.

4.4. Global Ban Synchronization: We utilize a centralized ban infrastructure. A ban issued in one server applies globally across the entire SynapseChat network.

Public Transparency: You acknowledge that if you violate these terms, your User ID, Username, and the reason for your ban may be publicly listed in our transparency logs to warn other server owners.

4.5. Distributed Moderation Authority (Admin Warning System): You acknowledge that moderation is a shared responsibility on the network.

Server Admin Authority: Administrators of connected servers are granted limited authority to issue global warnings to users who disrupt the network. Limitation: Server Administrators may only execute warning commands using the message's Unique ID, and they must execute these commands from within their own verified server.
SynapseChat Staff Authority: SynapseChat Official Staff retain unrestricted authority to issue warnings, bans, or mutes from any location within the network infrastructure (including the Support Hub or administrative panels).

5. Intellectual Property Rights

5.1. Our IP: The Service, including its code, branding, logos, and database structures, is the exclusive property of SynapseChat.

5.2. Your Content License: By sending a message through SynapseChat, you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your content in connection with the Service. This allows us to legally relay your message to other servers.

6. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNAPSECHAT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE CONTENT POSTED BY THIRD PARTIES OR FOR ANY DAMAGES THAT MAY RESULT FROM YOUR INTERACTION WITH OTHER USERS ON THE NETWORK.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SYNAPSECHAT, ITS DEVELOPERS, AFFILIATES, OR STAFF BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE LESSER OF: (A) THE ACTUAL AMOUNT PAID BY YOU TO SYNAPSECHAT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY; OR (B) CAD $150.00.

IF YOU HAVE NOT PAID SYNAPSECHAT ANY AMOUNT IN THE PREVIOUS 12 MONTHS, OUR TOTAL LIABILITY TO YOU SHALL BE ZERO (CAD $0.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless SynapseChat, its developers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

9. Dispute Resolution

9.1. Governing Law: These Terms shall be governed by the laws of the Province of Nova Scotia, Canada, without regard to conflict of law principles.

9.2. Exclusive Jurisdiction: You agree to submit to the personal and exclusive jurisdiction of the courts located within Halifax, Nova Scotia, Canada, for the resolution of any disputes.

9.3. Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE ADJUDICATED ON AN INDIVIDUAL BASIS, AND YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR OTHER JOINT ACTION WITH RESPECT TO ANY CLAIMS.
